Accra High Court Dismisses Gertrude Torkornoo's Application to Quash Justice Pwamang's Committee

The Accra High Court has reportedly dismissed an application filed by the Chief Justice, Her Ladyship Justice Gertrude Sackey Torkornoo, seeking to quash the proceedings of the Justice Pwamang Committee of Inquiry.

This was disclosed on Facebook by Nii Amarh Amarteifio, a seasoned media and public relations practitioner.

According to him, Justice Kwame Amoako, presiding over the court, ruled that the Chief Justice's application was an abuse of the court process and that the court lacked the jurisdiction to entertain the matter.

In delivering the ruling, Justice Amoako reportedly emphasised that the court’s jurisdiction was limited and could not be used to interfere with the proceedings of a validly constituted committee of inquiry.

Gertrude Torkornoo argued in her application that her constitutional rights were violated, stating she was not properly informed about the grounds on which the President and the Council of State made a prima facie determination regarding the petition against her.

She also claimed to have been subjected to invasive searches when appearing before the Pwamang Committee.

Additionally, the suspended Chief Justice raised concerns about the impartiality of Justice Gabriel Scott Pwamang.

However, the court dismissed the application, allowing the committee's proceedings to continue.

The court's decision has significant implications for the ongoing petition hearing against the suspended Chief Justice.

Gertrude Torkornoo's legal battles with the state

Gertrude Torkornoo is embroiled in a significant legal battle against the state as she fights to prevent her removal as the Chief Justice of the Republic of Ghana.

Her application at the Accra High Court comes several months after President John Dramani Mahama suspended her, following the determination of a prima facie case against her in connection with three separate petitions calling for her removal from office.

The President's decision, made in consultation with the Council of State, was announced on April 22, 2025, and was in accordance with Article 146(6) of the 1992 Constitution.

After the prima facie case was established, President Mahama formed a five-member committee, chaired by Justice Gabriel Scott Pwamang, to investigate the matter under Article 146(6).

The other members of the committee are Justice Samuel Kwame Adibu-Asiedu, Justice of the Supreme Court, Daniel Yaw Domelevo, former Auditor-General, Major Flora Bazaanura Dalugo, from the Ghana Armed Forces, and Professor James Sefah Dzisah, the Associate Professor, University of Ghana.

Gertrude Torkornoo heads to ECOWAS Court

Meanwhile, YEN.com.gh reported earlier that Chief Justice Gertrude Torkornoo filed a human rights case at the ECOWAS Court in Abuja over her suspension.

She argued that the suspension had removed her from office without due process, violating her constitutional rights.
